The trial court denied defendant’s anti-SLAPP motion. The appellate court affirmed, holding that the anti-SLAPP law did not apply because a sexual harassment investigation within a private company does not constitute an official proceeding, and an investigation by a private employer concerning a small group of people does not involve an issue of public interest.

The trial court found the anti-SLAPP motion was untimely because it was filed more than 60 days after service of the complaint. Harbison appealed. The appellate court dismissed the appeal as frivolous and sanctioned Harbison.
